IP due diligence – Case 1
Zacco was asked to perform a legal status and freedom to operate analysis for a company that provided solutions for cable TV and broadband. The objective was to gain capital.
The technology of the company was based on three areas. In two of the areas, analysis revealed third-party patent applications with the potential to influence the company’s freedom to operate. In the third area, documentation was discovered that could have presented problems regarding freedom to operate related to a product based on the current invention. Since at the time there was no product as such based on the PCT application, it was possible to use the findings in the future development of a product to avoid the problems identified.
A few potentially conflicting patents were also discovered. Zacco recommended that the company investigate the possibilities of filing oppositions or observations. The company was also advised to consider obtaining patents that could be the subject of cross licensing when setting up a patent strategy. |
