Today, design is a competitive factor – product design in many ways determines the success of a product. Protecting the appearance of a product is therefore critical to defend investments, secure the rights and credits of the designer and enable further development. This is particularly important on markets where a clear profile or image is necessary. Design protection is also a means to differentiate a product which does not otherwise stand out from a functional point of view.
Industrial designers are generally well acquainted with design registrations, but there are a number of other forms of protection available. The use or assembly of a product, or the functionality of a floor plan may have patentable characteristics. Utility models may provide protection in between the limitations and restrictions of designs and patents in a number of countries. Further, protection as 3-D or trade dress trademarks may be available as well as copyright and unfair competition, which is an unregistered right to be aware of. Inasmuch as protecting one’s own designs is crucial, respecting the rights of others by surveying competitors and checking for freedom to operate is also essential.
