IP rights must be defended to maintain their value. An IP right can either be defended by initiating legal proceedings or through mediation. Litigation and mediation are used to force those other than the rightful holders of an IP right to refrain from doing something, with litigation allowing the right holder to recover damages for the unlawful use of the protected IP right.
To initiate legal proceedings, the right holder must file a lawsuit with a competent court. In the mediation process, the parties are amicable in dealing with the case and rely on a mediator to assist them in finding an amicable solution to the conflict between them.
