The Intellectual Property Laws Amendment (Raising the Bar) Act 2011 received Royal Assent on 15 April 2012, and as such most provisions will take effect from 15 April 2013.
This is the most significant amendment to Australia’s intellectual property laws since the commencement of the Patents Act 1990. The legislation will, amongst other things, extend legal professional privilege, introduce an experimental use exemption from infringement, result in a significant increase in the requirements for inventive step and support, will restrict the nature of amendments that can be filed and the lodgement of divisionals and will result in a shortening of the response period for patent examination. The presentation will focus on the practical implications of the changes and will provide specific recommendations for changes to practice that will be required to meet the new requirements. The presentation will also include some brief information about New Zealand patent practice and software and business method patents in Australia and New Zealand.
