For over 40 years a common patent system for Europe has been discussed. The European Parliament decided in December to adopt the so-called Unitary Patent. The new Unitary Patent system will be initiated at the earliest by January 1st, 2014 and will serve as a complement to the existing European Patent system.
For some companies the new system implies several benefits, such as simplified application, validation and translation requirements and thus reduced administrative costs. For others it can mean a risky option that exposes patent holders to the threat of litigation and nullification of patent rights across all of Europe in one court procedure.
