Norway joins the London agreement

On January 1st 2015 The London Agreement entered into force for Norway. If a European patent granted in English is to be validated in Norway, only the patent claims have to be translated into Norwegian. However, if the European patent is granted in French or German, the description must be translated into Norwegian or English.

Another related legislation change also enters into force on 1st January 2015.

  • For national patent applications filed in Norway on or after this date and international patent applications entering national phase in Norway on or after this date, the application may be filed in English or Norwegian. If the application is filed in English, the patent claims have to be translated into Norwegian upon grant. If requested by the applicant the Norwegian Patent Office will issue Office Actions in English.
  • For national patent applications filed in Norway prior to this date and international patent applications that have entered national phase in Norway prior to this date, the Norwegian Patent Office will issue further Office Actions in English if the applicant so requests.
  • If the application is filed in English, a Norwegian translation of the claims must be filed in order to secure provisional protection.
