A patent puts the patent owner in a monopoly position. A correct definition of the invention and formulation of the claims are crucial for effective patent protection. At Zacco, this is something that we have learnt from 140 years of experience.
Three basic criteria
A patent protection is often the basis for an entire business. Three basic criteria must be met in order for your product or method to be patentable, the invention must:
- Be novel. It must not be known to the public anywhere in the world before the filing date of the patent application.
- Involve an inventive step. It must differ significantly from what is known before the filing date of the patent application.
- Be capable of industrial utilization.
How to apply
To get a national patent, you may file the application at a national Patent Office. The scope of protection is determined by the patent claims. Zacco’s attorneys assure that your patent application is drafted and prosecuted such that your invention gets the best possible protection.
Period of protection
A patent can usually be maintained for a maximum of 20 years. In order for a patent to be maintained, maintenance fees must be paid.
A patent granted in a specific country is normally valid in that country only. At Zacco we can help you submit a European patent application directly to the European Patent Office (EPO). An alternative procedure is to make use of the Patent Cooperation Treaty (PCT) which provides a non-binding assessment in over 140 member states.
