IP Risk Management
A concern for every business
IP Risk Management is all about identifying potential risks connected to your intellectual property. After their identification, all risks are prioritised to determine the resources that need to be allocated to manage them.
Whether or not you have an IP portfolio, IP risk management is relevant to you. You are at all times exposed to the risk of IP rights infringement – be it that you infringe the rights of others or that your rights as an IP rights holder are infringed. IP infringement, whether you are infringing or being infringed, are high-risk matters. They can have significant consequences for your business strategy, finances and reputation.
As it is, the probability of risk should always be balanced by the resources that are spent trying to eliminate them – sometimes a risk is acceptable to take, sometimes it is not.
An IP risk analysis can suggest which measures to implement to mitigate any detected IP risks. For patents, risk management can include Freedom To Operate analyses, FTO, to evaluate the relevance of patents and other disclosures found in a search and determine whether they can have any impact on your own commercial activities.
